Terms and Conditions

Counseling Breakthrough, LLC, offers Life Coaching to global clients and Internet-Therapy for Virginia residents only as an accessible and, in some cases, more affordable alternative to traditional in-office therapy.  Lauren Trecosta offers quality information, psycho-education, support and coaching for relationship and common, current ‘life’ problems.  Neither Life Coaching nor online counseling is not intended to provide in-depth psychotherapy and should not be considered a substitute for traditional in-office psycho-therapy.

When you enter into an on-line counseling session with Lauren Trecosta, LPC, it is as if you are participating in a counseling session with Lauren Trecosta, LCP, in the state of Virginia where the therapist is licensed.

When you enter into a Life Coaching session with Lauren Trecosta, you are participating in educational, motivational, inspirational, awareness building sessions that help you both visualize the life you want, develop strategies and steps to achieve it, as well apply and refine action and learning in real life time.

You are responsible for your thoughts, words, decisions, and behaviors at all times.  Under no circumstance is Counseling Breakthrough or any communication from Counseling Breakthrough or Lauren Trecosta, LPC or Life Coach, responsible for your thoughts, words, decisions, or actions.  You are the filter through which all information is received, processed, and resulting decisions and behaviors are made.

When should I seek traditional mental health treatment rather than Life Coaching or internet counseling?

  • If you are having thoughts of harming yourself (i.e. suicidal thoughts) or someone else (i.e. violent thoughts toward others), or psychotic symptoms.  Call 1-800-273-TALK (8255) or someone else (i.e. violent thoughts toward others), or psychotic symptoms.
  • If you are in an abusive or violent relationship.
  • If you have been seriously and deeply depressed.
  • If you are suffering from serious mental health disorders including, but not limited to, addiction, schizophrenia, bi-polar disorder, PTSD, or dissociation.
  • If you are in crisis and need immediate attention, including violent thoughts to yourself (suicide) or others (homicide), child protection, trauma, domestic violence, or sexual assault.  In those cases, call 911 and go to your nearest emergency health facility.
  • If you are in need of assessment, diagnosis, medication management, or intensive psycho-therapy.
  • If you are a minor (under 18 years old).

Confidentiality

Confidentiality is the cornerstone of counseling whether in virtual or traditional in-office settings.  Mental health practitioners, however, are mandated reporters and required, by law, to report — and therefore break confidentiality — in four specific instances.  They are as follows.

Limits to confidentiality:

The therapist is mandated, by law, to break confidentiality, if she suspects:

  • you are at risk of harming yourself (suicidal);
  • you are at risk of harming others (homicidal)

If you are feeling suicidal or homicidal, please call

  • the abuse or neglect of a minor or vulnerable adult; or
  • if a court of law requests information.

Special Privacy Concerns

Counseling Breakthrough does not receive any information about your credit card information.  All credit card information is processed securely through Paypal.

If you choose to send an email to Lauren through Ask Lauren, you agree you knowingly forego the privacy of your email and the therapist’s response to it.  You further understand that your email will be posted anonymously as well as the therapist’s response to your email will be posted on the Ask Lauren column.

Counseling Breakthrough will not sell, give, or trade your email or personal information to a third party.

At the present time total security with online communication is not absolute in any medium and is therefore not guaranteed and is at the clients own risk and responsibility. Privacy may be compromised by computer, human, and network errors.  You are responsible for the security of your own computer, laptop, log-in and registration information.  However, the chances of someone having the expertise or the interest to hack into conversations is rather rare. We do provide state of the art SSL (Secure Socket Layer) for all the information and interaction saved and transmitted to our website. Webcam and teleconference services are provided by Skype and Webex, privacy and security for those services are covered by those companies’ respective privacy and security policies. Cancellation Policies

  • All sessions are paid for with automatic credit card payment schedule set up through mutual arrangement via Paypal.

  • Should you need to reschedule an appointment with more than 24 hours notice, Lauren Trecosta will make every reasonable effort to accommodate within the same week. There may be times, however, when either your schedule or mine will not allow for rescheduling within the same week. In those cases, the appointment is lost and the sliding scale session cost is forfeited by the client. Clients at full-pay may transfer their session to a future week if needed.

  • Appointments that are no show or cancelled with fewer than 24 hours notice will be paid for in full with no option to reschedule.

  • Should Lauren Trecosta need to reschedule an appointment, every reasonable effort will be made to reschedule within the week. If it is not possible, the client suffers no financial loss.

Please read the following terms and conditions of the CounselingBreakthrough.com Agreement carefully and in its entirety. If you agree to the following terms you may view or use any of Counselingbreakthrough.com’s discussions, e-mail advice group, on-line counseling, psycho-educational programs, and support/therapeutic groups.   If you do not wish to be bound by the terms and conditions of this Agreement, you may not view or use any of Counselingbreakthrough.com’s discussions, e-mail advice group, on-line counseling, psycho-educational programs, and support/therapeutic groups.

1)      All references to CounselingBreakthrough.com in this Agreement shall include the website, discussions, e-mail advice group, on-line counseling, psycho-educational programs, and support/therapeutic groups, and, and its directors, officers, employees, shareholders, agents, affiliates, and attorneys, as applicable.

2)      Access to view and/or use CounselingBreakthrough.com’s discussions, e-mail advice group, on-line counseling and psycho-educational programs, support/therapeutic groups, and services are intended for individuals eighteen years of age and older who do not suffer from a major mental disorder.

3)      Any amendment, change, or modification of this Agreement shall be made only under the express written direction of CounselingBreakthrough.com. This will be done through the posting of any amendment, change, or modification of this Agreement on the CounselingBreakthrough.com website. Any viewing or use of CounselingBreakthrough.com by you shall be deemed an acceptance by you of any amendment, change or modification of this Agreement by CounselingBreakthrough.com.

4)      The information contained in CounselingBreakthrough.com’s discussions, e-mail advice group, on-line counseling, psycho-educational programs, and support/therapeutic groups are specifically for educational purposes only. They are not intended to, and do not provide, professional advice for mental health counseling; nor are they to be a substitute for professional mental health counseling or therapy in the traditional office setting. You should not rely upon the information contained in CounselingBreakthrough.com’s discussions, e-mail advice group, on-line counseling, psycho-educational programs, and support/therapeutic groups for medical, legal, or financial decisions. You should consult a mental health professional in a traditional office environment for advice or treatment regarding any mental health concerns.

5)      You may view and/or use CounselingBreakthrough.com’s discussions, e-mail advice group, on-line counseling, psycho-educational programs, and support/therapeutic groups subject to the terms and conditions of this Agreement. You may download or print a copy of any information provided by CounselingBreakthrough.com for your personal use only. Any other use in framing, downloading, or printing a copy of any information provided by CounselingBreakthrough.com is expressly prohibited unless prior written consent is specifically provided by the holder of the copyright of the information and by CounselingBreakthrough.com.

6)      CounselingBreakthrough.com does not guarantee or warrant that CounselingBreakthrough.com is free of viruses or other code containing destructive properties. You are responsible for implementing reasonable measures to prevent the loss of code or data belonging to you. CounselingBreakthrough.com does not assume any responsibility for your use of any information or data taken from said website.

7)      COUNSELINGBREKTHROUGH.COM DOES NOT MAKE ANY EXPRESSED OR IMPLIED WARRANTIES, REPRESENTATIONS, OR ENDORSEMENTS, INCLUDING ANY WARRANTIES OF TITLE OR NON-INFRINGEMENT OF THIRD PARTIES’ RIGHTS, OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH REGARD TO ANY INFORMATION OR MERCHANDISE PROVIDED BY OR THROUGH COUNSELINGBREAKTHROUGH.COM, EXCEPT AS OTHERWISE SPECIFIED BY COUNSELINGBREAKTHROUGH.COM. COUNSELINGBREAKTHROUGH.COM DOES NOT WARRANT THE ACCURACY, TIMELINESS OR USEFULNESS OF ANY INFORMATION OR MERCHANDISE PROVIDED BY OR THROUGH COUNSELINGBREAKTHROUGH.COM.

8)      CounselingBreakthrough.com shall not be liable to anyone for any act or omission taken in reliance upon any information provided by CounselingBreakthrough.com. You may not use CounselingBreakthrough.com for any unlawful purpose or for that which is prohibited by this Agreement. CounselingBreakthrough.com may deny you access to CounselingBreakthrough.com at any time for any reason at the sole discretion of CounselingBreakthrough.com.

9)      CounselingBreakthrough.com shall not be liable for any damages whatsoever, including but not limited to, damages for personal injury or wrongful death, loss of business profits, business interruption, or loss of data, arising out of the viewing or use of, or inability to view or use, CounselingBreakthrough.com’s discussions, e-mail advice group, on-line counseling, psycho-educational programs, and support/therapeutic groups, or for any reason whatsoever. You agree to fully defend and indemnify CounselingBreakthrough.com from any legal action arising from your viewing or use of CounselingBreakthrough.com discussions, e-mail advice group, on-line counseling, psycho-educational programs, and support/therapeutic groups. You are solely responsible for communications and/or materials you post or transmit on CounselingBreakthrough.com’s discussions, e-mail advice group, on-line counseling, psycho-educational programs, and support/therapeutic groups.

10)  CounselingBreakthrough.com does not and cannot review all communications and/or materials posted on its discussions, e-mail advice group, on-line counseling, psycho-educational programs, and support/therapeutic groups, and, as such, is not responsible in any manner for the content of posted communications or materials. You may not post or transmit any communications or materials, and CounselingBreakthrough.com has the right to block or delete any communications or materials, on CounselingBreakthrough.com’s discussions, e-mail advice group, on-line counseling, psycho-educational programs, and support/therapeutic groups that may:

a)      be libelous, defamatory, or discloses private or personal information about another person, indecent, obscene, offensive, or pornographic, offensive, harmful, threatening, harassing, abusive, hateful, fraudulent, deceptive, or misleading, or constitute stalking,

b)      the privacy and/or property rights of others, including any unauthorized copyrighted communications or materials, trade secrets, protected intellectual property rights, or other confidential or trademarked proprietary information,

c)      interfere with the viewing or use by others of CounselingBreakthrough.com’s forums, discussion groups, and services, use simultaneous, unattended or continuous connections to CounselingBreakthrough.com, or post or transmit any file containing any viruses or any contaminating or destructive code or features,

d)      be requests for charity, petitions for signatures, chain letters, or communications or materials for any pyramid schemes, advertising, solicitations, or promotional communications or materials of any kind, or be used to harvest or collect information about other users of the forums, discussion groups, and services on CounselingBreakthrough.com, or

e)      be deemed unacceptable for any reason by CounselingBreakthrough.com. CounselingBreakthrough.com may take steps, if deemed necessary, to investigate any violation of this Agreement, including the recording of any communications or materials in its forum, discussion groups, and services.

11)  You further agree that your registration for any forums, discussion groups, and services in CounselingBreakthrough.com is true and correct, and that if any information in your registration changes, you will correct your registration immediately, you will not allow another person to have access to any forums, discussion groups, and services in CounselingBreakthrough.com under your registration, you will not impersonate any other person or entity in any forums, discussion groups, and services in CounselingBreakthrough.com, you will not post any communications or materials that you know or reasonably should know is false, you will not mislead others about your identity, education, credentials, knowledge or experience, and that you will not collect any information whatsoever about other users of CounselingBreakthrough.com.

12)  The parties to this Agreement agree that any claim, controversy, or dispute arising out of any viewing or use of CounselingBreakthrough.com shall first be subject to mediation between the parties; in addition, such mediation will be conducted in accordance within the rules and procedures of the American Arbitration Association, the American Health Lawyers Association Alternative Dispute Resolution Service, or such other third party dispute resolution mechanism as the parties hereto agree. In the event the dispute is not resolved by mediation, the parties agree that any such unresolved dispute shall be subject to binding arbitration under the rules and procedures of the American Arbitration Association, the American Health Lawyers Association Alternative Dispute Resolution Service, or such other third party dispute resolution mechanism as the parties hereto agree, and that they are waiving their right to a jury or court trial. However, the arbitrator(s) of such dispute may not be individuals who previously served as the mediator of the dispute. Said mediations or arbitration’s shall be conducted in Fairfax, Virginia, and Arbitration’s shall require a panel of three arbitrators. Judgment upon the award entered by the arbitrators shall be binding upon the parties and may be entered by either party in a court of competent jurisdiction. The costs of mediation shall be split equally by the parties. The costs of arbitration shall be subject to an order of the panel of arbitrators. The prevailing party shall be entitled to an order awarding it all reasonable costs and attorneys’ fees incurred by reason of the dispute, including the costs of any expert witnesses or consultants.

13)  Notices hereunder must be in writing and must be delivered by the U.S. Postal Service or a United States national overnight delivery service, addressed as follows. Notices to CounselingBreakthrough.com must be addressed to: CounselingBreakthrough.com, attention: Ms. Lauren Trecosta, 5010 Portsmouth Road; Fairfax, VA  22032. Notices shall be deemed effective five business days after deposit with the U.S. Postal Service or two business days after deposit with a United States national overnight delivery service.

14)  The parties agree that, regardless of any statute, rule, or regulation to the contrary, any claim or cause of action against the other party arising out of or relating to this Agreement or viewing or use of CounselingBreakthrough.com must be filed within one year after such claim or cause of action arose.

15)  CounselingBreakthrough.com is not responsible for delays or failure in performance resulting from acts beyond the control of CounselingBreakthrough.com Such acts shall include but are not limited to acts of God, strikes, lockouts, riots, acts of war, epidemics, governmental regulations superimposed after the fact, fire, communication line failures, power failures, earthquakes, or other disasters.

16)  No alleged past or present written or oral agreement or representation, course of conduct by you or CounselingBreakthrough.com, or any trade practice shall act to modify this Agreement. The provisions set forth in this Agreement are the only terms and conditions of the Agreement. The provisions of this Agreement shall be severable; in the event any portion of this agreement is deemed unenforceable, such unenforceability shall not affect the enforceability of the remaining portions of the Agreement.

17)  This Agreement incorporates by reference all other Agreements contained in the CounselingBreakthrough.com website in their entirety.

18)  I have read and accepted the above terms and conditions and I understand and agree to be bound by the terms and conditions of this Agreement. If I do not wish to be bound by the terms and conditions of this Agreement, I may not view or use any of CounselingBreakthrough.com’s discussions, e-mail advice group, on-line counseling, psycho-educational programs, and support/therapeutic groups.

19)  I have read and accepted the above terms and conditions and I understand and agree to be bound by the terms and conditions of this Agreement. If I do not wish to be bound by the terms and conditions of this Agreement, I may not view or use any of CounselingBreakthrough.com’s forums and discussion groups, e-mail advice group, psycho-educational programs and counseling services.
